1. Introduction

Welcome to Artiflow. These Terms and Conditions ("Terms") govern your access to and use of the Artiflow website, platform, and AI-powered image and video generation services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. Please read them carefully before using Artiflow.

2. Acceptance of Terms

By creating an account, purchasing credits, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 18 years old to use Artiflow. By using the Service, you represent and warrant that you meet this age requirement.

3. Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information during registration.
Keep your login credentials secure and confidential at all times.
Notify us immediately of any unauthorized access to or use of your account.
Maintain only one account per person. Duplicate accounts may be suspended without notice.

You are solely responsible for all activity that occurs under your account. Artiflow shall not be liable for any loss or damage arising from your failure to maintain account security.

4. Credits and Payments

Artiflow operates on a credit-based system. Credits are used to generate AI images and videos on the platform. By purchasing credits, you agree to the following terms:

All credit purchases are final and non-refundable, except where otherwise required by applicable law.
Credits do not expire and will remain in your account until used.
Credits are non-transferable and may not be shared between accounts.
Credit costs for generation vary based on the complexity of the request, including image size and video duration. Typical usage ranges from 1 to 4 credits for images, with higher costs for video generation.

Artiflow reserves the right to adjust credit pricing at any time. Any changes to pricing will be communicated in advance and will not affect credits already purchased.

5. AI-Generated Content

When you use Artiflow to generate images or videos, the following terms apply to the content produced:

You retain full ownership of content generated using your credits.
Generated content may be used for both personal and commercial purposes, subject to compliance with these Terms and applicable laws.
Artiflow does not guarantee specific results from any generation request. Output quality may vary depending on the prompt, model, and parameters used.
AI-generated content may occasionally produce unexpected, inaccurate, or imperfect results. Artiflow is not liable for the nature or quality of generated output.

You agree not to use AI-generated content in ways that violate any laws, infringe third-party rights, or breach these Terms.

6. User Content and Uploads

When uploading reference images or other content to the Service, you represent and warrant that:

You own the content or hold all necessary rights, licenses, and permissions to upload and use it.
Your content does not infringe upon any third-party intellectual property rights, including copyright, trademark, or patent.
Your content complies with our content guidelines and all applicable laws and regulations.
You grant Artiflow a limited, non-exclusive, royalty-free license to process your uploaded content solely for the purpose of providing the Service.

Artiflow does not claim ownership of your uploaded content. We will not use your uploads for any purpose other than delivering the Service to you.

7. Prohibited Uses

You agree not to use Artiflow or its Service to:

Create, distribute, or promote content that violates any applicable laws or regulations.
Generate content that is defamatory, threatening, harassing, hateful, or that promotes violence or discrimination.
Create content that depicts minors in inappropriate, sexual, or harmful contexts.
Generate content that impersonates real individuals, public figures, or entities without their explicit consent.
Upload malicious files, scripts, or code intended to compromise, disrupt, or gain unauthorized access to our systems.
Circumvent, disable, or otherwise interfere with any security features, access controls, or usage restrictions of the Service.
Resell, sublicense, or redistribute access to the Service or generated credits to third parties without prior written authorization.

Violation of these prohibitions may result in immediate suspension or termination of your account, without refund, and may expose you to legal liability.

8. Intellectual Property

The Artiflow platform, including its website design, features, AI models, templates, branding, and all associated intellectual property, is owned by Artiflow and protected under applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, sublicense, or reverse engineer any part of the Service or its underlying technology without the explicit prior written permission of Artiflow. Unauthorized use of our intellectual property may result in legal action.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy, available at artiflow.ai/privacy-policy.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARTIFLOW DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated content may not always meet your expectations. Artiflow is not responsible for any content generated by users or the AI models on our platform.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARTIFLOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN ALL CASES, ARTIFLOW'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO ARTIFLOW IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Termination

Artiflow reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, for any violation of these Terms and Conditions or for conduct we determine to be harmful to the Service, other users, or third parties.

Upon termination, your right to access and use the Service will immediately cease. Any unused credits remaining in your account at the time of termination for cause will be forfeited. You may delete your account at any time through your account settings.

13. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Sharjah, United Arab Emirates.

We encourage you to contact us first to resolve any disputes informally before initiating formal legal proceedings.

14. Changes to These Terms

Artiflow reserves the right to update or modify these Terms and Conditions at any time. When we make material changes, we will notify you by posting the updated Terms on this page and revising the effective date at the top of the document.

Your continued use of the Service following the posting of any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.
